Section 1
Scope; Applicability; Controller Identity

This Privacy Policy ("Policy") applies to all personal information collected, processed, or maintained by Property Help Services LLC, a Florida limited liability company operating under the trade name Property Matters 24/7 ("Company," "we," "us," or "our"), in connection with the operation of its property damage referral service ("Service") and its associated digital platform accessible at propertymatters247.com and all affiliated domain names ("Platform").

This Policy applies to information collected through any channel by which individuals interact with the Company, including but not limited to: inbound and outbound telephone communications; web-based inquiry and contact forms; electronic mail communications; text message (SMS/MMS) exchanges; and any other electronic or analog communication medium through which personal information may be transmitted to or collected by the Company.

The Company serves as the data controller with respect to personal information collected directly from individuals in connection with the Service. With respect to personal information transmitted to Network Contractors, such contractors operate as independent data controllers subject to their own privacy practices and policies.

This Policy does not apply to information collected by Network Contractors following the referral connection. Users are encouraged to review the privacy policies of any Network Contractor with whom they engage.
Section 2
Categories of Personal Information Collected

The Company collects personal information from individuals in the following categories, depending on the nature and context of the interaction:

The Company does not knowingly collect sensitive personal information including Social Security numbers, government-issued identification numbers, financial account information, payment card data, health or medical information, or biometric identifiers in connection with the Service. If any such information is incidentally transmitted to the Company, it will not be retained or processed for any purpose.

Section 3
Purposes and Legal Bases for Processing

The Company collects, uses, and processes personal information for the following purposes:

3.1 Service Delivery. To receive, evaluate, and respond to property damage inquiries; to identify and connect Users with appropriate Network Contractors; to facilitate the referral process; and to communicate with Users regarding the status of their inquiry and any follow-up matters.

3.2 Communications. To initiate and conduct telephone, text message, and electronic mail communications with Users in connection with their property damage inquiry, including automated and prerecorded communications where applicable consent has been obtained in accordance with the Telephone Consumer Protection Act, 47 U.S.C. § 227, and the Florida Telephone Solicitation Act, Fla. Stat. § 501.059.

3.3 Network Contractor Referral. To transmit relevant User contact and property damage information to one or more Network Contractors for the purpose of facilitating the referral and enabling the contractor to contact the User regarding potential services.

3.4 Quality Assurance and Compliance. To monitor, record, and review communications for purposes of quality assurance, personnel training, regulatory compliance, and maintenance of records required by applicable law.

3.5 Platform Analytics and Improvement. To analyze usage patterns, traffic sources, and user behavior on the Platform for purposes of improving the functionality, content, and user experience of the Platform.

3.6 Legal Obligations and Dispute Resolution. To comply with applicable legal and regulatory obligations; to enforce the Company's Terms of Use; to investigate potential violations; and to establish, exercise, or defend legal claims.

Section 4
Disclosure of Personal Information to Third Parties

The Company does not sell personal information to third parties for monetary consideration. The Company may disclose personal information to the following categories of recipients under the following circumstances:

4.1 Network Contractors. The Company will disclose User contact information and property damage inquiry details to one or more Network Contractors for the purpose of facilitating the referral connection that is the core function of the Service. This disclosure is made with the User's knowledge and constitutes the primary purpose for which the information was collected. Users acknowledge and agree that Network Contractors, upon receipt of such information, become independent data controllers with respect to that information and are subject to their own privacy practices.

4.2 Service Providers. The Company may engage third-party service providers to assist in the operation of the Service and Platform, including but not limited to: telephony and communications platform providers; web hosting and content delivery providers; form processing and lead management platform providers; analytics service providers; and electronic mail service providers. Such service providers are authorized to process personal information only as necessary to perform services on behalf of the Company and are subject to confidentiality obligations.

4.3 Legal and Regulatory Disclosures. The Company may disclose personal information where required or permitted by applicable law, regulation, judicial order, subpoena, governmental request, or legal process; or where the Company in good faith believes disclosure is necessary to protect the rights, property, or safety of the Company, its personnel, Users, or the public.

4.4 Business Transfers. In the event of a merger, acquisition, reorganization, sale of assets, or similar corporate transaction involving the Company, personal information held by the Company may be transferred to the acquiring or successor entity as part of such transaction, subject to confidentiality obligations consistent with this Policy.

Section 5
Data Retention

The Company retains personal information for as long as reasonably necessary to fulfill the purposes for which it was collected, to comply with applicable legal and regulatory obligations, and to resolve disputes and enforce agreements.

Call recordings and associated communication records are retained for a period of not less than twenty-four (24) months from the date of the recorded communication, or such longer period as may be required by applicable law or as necessary for pending or anticipated legal proceedings.

Inquiry and referral records, including User contact information and property damage descriptions, are retained for a period of not less than thirty-six (36) months from the date of initial inquiry, in order to support quality assurance reviews, dispute resolution, and regulatory compliance obligations.

Technical and usage data collected automatically through Platform analytics is retained in accordance with the data retention policies of the applicable analytics service provider, which in no event shall exceed twenty-six (26) months from the date of collection.

Upon expiration of the applicable retention period, personal information will be securely deleted, anonymized, or de-identified in accordance with industry-standard data destruction practices.

Section 6
Cookies and Automated Data Collection Technologies

The Platform may utilize cookies, web beacons, pixel tags, session identifiers, local storage objects, and similar automated data collection technologies to collect technical and usage information from visitors to the Platform. Such technologies may be used for purposes including but not limited to: maintaining session continuity; analyzing traffic patterns and user engagement; measuring the effectiveness of the Platform; and supporting the functionality of third-party analytics services integrated into the Platform.

Users may configure their web browser to refuse all cookies or to alert the browser when cookies are being sent. Certain features or functionality of the Platform may not operate as intended if cookies are disabled. The Company does not respond to browser "Do Not Track" signals at this time, as no uniform industry standard for such signals has been established.

To the extent the Platform integrates third-party analytics services, including Google Analytics or similar providers, such services may collect information regarding Platform usage pursuant to their own privacy policies, which are independent of and not governed by this Policy.

Section 7
Individual Rights; Access, Correction, and Deletion Requests

Subject to applicable law and the limitations described herein, individuals may have the following rights with respect to personal information maintained by the Company:

7.1 Right of Access. The right to request confirmation as to whether the Company maintains personal information about the requesting individual, and if so, to receive a copy of such information in a reasonably accessible format.

7.2 Right of Correction. The right to request correction of inaccurate or incomplete personal information maintained by the Company.

7.3 Right of Deletion. The right to request deletion of personal information maintained by the Company, subject to the Company's legal obligations to retain certain records and to the Company's legitimate interest in maintaining records necessary for dispute resolution and legal defense.

7.4 Right to Opt Out of Communications. The right to withdraw consent to receive marketing or promotional communications from the Company at any time, without prejudice to the lawfulness of communications made prior to withdrawal of consent. Opt-out requests for text message communications may be submitted by replying "STOP" to any text message. Opt-out requests for other communications may be submitted to the contact information set forth in Section 9.

Requests to exercise any of the foregoing rights should be submitted in writing to the Company's contact information set forth in Section 9 of this Policy. The Company reserves the right to verify the identity of the requesting individual prior to fulfilling any access, correction, or deletion request.

The exercise of these rights is subject to applicable exceptions under federal and state law, including but not limited to exceptions for information necessary to complete a transaction, to detect and prevent security incidents, to comply with legal obligations, or to exercise or defend legal claims.

Section 8
Data Security; Limitations

The Company implements commercially reasonable administrative, technical, and physical security measures designed to protect personal information from unauthorized access, use, alteration, disclosure, or destruction. Such measures include, without limitation, access controls, encrypted data transmission protocols, and restricted access to personal information on a need-to-know basis.

NOTWITHSTANDING THE FOREGOING, NO DATA TRANSMISSION OVER THE INTERNET OR ELECTRONIC STORAGE SYSTEM CAN BE GUARANTEED TO BE COMPLETELY SECURE. THE COMPANY DOES NOT WARRANT OR REPRESENT THAT PERSONAL INFORMATION WILL BE PROTECTED AGAINST LOSS, MISUSE, OR ALTERATION BY THIRD PARTIES. ANY TRANSMISSION OF PERSONAL INFORMATION TO THE COMPANY IS AT THE USER'S OWN RISK.

In the event of a data security incident involving unauthorized access to or disclosure of personal information that triggers notification obligations under applicable state or federal law, the Company will provide required notifications in accordance with such obligations.

Section 9
Children's Privacy

The Service and Platform are not directed to individuals under the age of eighteen (18) years. The Company does not knowingly collect personal information from individuals under the age of eighteen (18). If the Company becomes aware that it has inadvertently collected personal information from an individual under the age of eighteen (18), it will take prompt steps to delete such information from its records.

If a parent or legal guardian believes that their minor child has submitted personal information to the Company, they are encouraged to contact the Company at the contact information set forth in Section 10 of this Policy to request deletion of such information.

Section 10
Policy Updates; Governing Law; Contact Information

10.1 Policy Updates. The Company reserves the right to modify, amend, or update this Policy at any time in its sole discretion. The effective date displayed at the top of this Policy reflects the date of the most recent revision. Material changes to this Policy will be reflected in an updated effective date. Continued use of the Service or Platform following any revision constitutes acceptance of the revised Policy.

10.2 Governing Law. This Policy and all matters relating to the Company's privacy practices shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. Any disputes arising under this Policy shall be subject to the exclusive jurisdiction of the state and federal courts of competent jurisdiction located in Seminole County, Florida.
